Does the problem engaging 1st and 2nd gear only happen when the engine is cold and improve after a few minutes of driving? If so gear oil may be too thick

Sounds a bit similar to a problem I had with my 2012 D40 4wd manual after the dealer replaced the gearbox oil with the recommended oil. Very difficult to change into and from first on startup when cold but IK after the engine warmed up. Dealer replaced clutch for $3000 - didn’t fix the problem...
